National: SCJN Recognizes Mandatory Nature of UN Urgent Actions on Forced Disappearances

On June 16th, the Supreme Court of Justice of the Nation (SCJN) accepted the mandatory nature of Urgent Actions issued by the UN Committee against Forced Disappearance (CED), as well as the right of relatives of a disappeared person to participate in search and investigation procedures. Organizations such as the National Human Rights Commission (CNDH), the National Search Commission positively valued this decision. “It is important to highlight the fundamental role of the judicial powers in combating enforced disappearances. The decision of the First Chamber of the SCJN represents a great advance in the fight against this crime and the recognition of the rights of the victims”, said Guillermo Fernandez Maldonado, Representative of the UNHCHR in Mexico.

The SCJN ordered the Mexican authorities to implement the measures recommended by the CED in the 284 urgent actions that are active for Mexico and to which more may be added from now on.

This decision derives from the ruling on the protection under review 1077/2019 related to the forced disappearance of the youth Víctor Alvarez Damian, which occurred on December 11th, 2013 in the port of Veracruz. By doing this, the SCJN recognized the obligation of the prosecution to undertake the search for missing or non-located persons to determine the fate or whereabouts of the disappeared youth, as well as to investigate the facts that led to his disappearance and the possible perpetrators.
