In September, the National Human Rights Commission (CNDH) issued a Recommendation to the Governor of Chiapas, Rutilio Escandon and to the President of the State Human Rights Commission (CEDH), Juan Jose Zepeda Bermudez “for the omission of presenting an initiative of law that allows the citizens of the state to make modifications to the birth certificate through a simple, expeditious and transparent administrative procedure.”
This followed the Civil Registry denying the possibility to four people to change their name and sex with which they were registered at the time of their birth, to the current one with which they are identified publicly and in front of society for reasons of gender identity, for more than five years.
The institution argued that the process “must be required through a trial of rectification and modification of the birth certificate.” For this reason, the affected persons filed a complaint with the Chiapas ECHR who considered that “there are no elements to attribute to the General Directorate of the Civil Registry of the State of Chiapas, violations of human rights”, whereby, on October 8th, 2020, it issued the Agreement of Non-Responsibility (ACNR).
However, the affected parties contested this decision and the Autonomous Public Body found omission by public servants of the state government and the ECHR “by not having taken the necessary legal actions to be able to see to the case.” It added that this evidences towards all the victims “unequal, discriminatory treatment and, against their right to identity and name.”
The CNDH issued seven recommendations, among them, “proceed to repair the damage caused to the victims, under the terms of the Victims Law for the state of Chiapas”; in addition to designing a comprehensive training program in human rights for the General Secretariat of Government, Undersecretariat of Government and Directorate of the Civil Registry of the entity.
