Chiapas: 9 prisoners in solidarity with the Voz del Amate released, but Patishtán will remain imprisoned

On 4 July 9 prisoners who adhere to the EZLN’s Sixth Declaration were released from the San Cristóbal prison, following three days of waiting after their forthcoming release had been announced (on Tuesday).  Outside the prison, in rain and shine, their mothers, wives, and children awaited them.  Governor Manuel Velasco Coello arrived to the prison to hand over to the indigenous their acts of release, after having interviewed each one.  Those who were allowed to leave prison no. 5 include the following: Rosario Díaz Méndez, Pedro López Jiménez, Juan Collazo Jiménez, Juan Díaz López, Rosa López Díaz, Alfredo López Jiménez, Juan López González, and Benjamín López Díaz.  The professor Alberto Patishtán Gómez, member of the Voz del Amate who has been imprisoned for 13 years, will remain incarcerated together with Alejandro Díaz Sántiz, a prisoner in solidarity with the Voz del Amate. During the night, the liberated indigenous ex-prisoners came to the San Cristóbal cathedral to visit the tomb of former bishop Samuel Ruiz García.

Chiapas: Rosario Díaz Méndez sentenced to 20 years’ imprisonment

Rosario Díaz Méndez, member of the Voz del Amate and prisoner held in the No. 5 Prison of San Cristóbal de las Casas, Chiapas, was sentenced on 5 June to 20 years’ imprisonment for the crime of kidnapping.  He has always claimed that the charges were fabricated against him, for his “having opposed the planned suspension of devices to measure potable water, as was being suffered in my municipality of Huitiupán at the hands of the City Hall authorities and mayor Heinal González López during the years 2005-2008.  This very person was who organized the people who have accused me of kidnapping,” noted Díaz Méndez in a communique.

It was for this reason that he called on state governor Manuel Velasco Coello to intercede so that he be released from “this unjust incarceration,” as he had committed himself to doing on 18 April during a visit to the San Cristóbal prison, when he promised to advanced the cause of the release of the indigenous who form part of the organization those in solidarity with the Voz del Amate, as of Rosario Díaz himself.

On 22 February there was held a protest march within prison no. 5 in San Cristóbal de Las Casas, Chiapas, to denounce the injustices carried out gainst Rosario Díaz Méndez, who was newly sentenced to 25 years at the end of January.  Those in solidarity with the Voz del Amate together with proper members of this organization (Rosario and Alberto Patishtán Gómez) made public an audio declaration in which they called on the state governor, Manuel Velasco Coello, to “put an end to these unjust incarcerations, immediately and without conditions.”

It should be noted that Rosario Díaz has always maintained his innocence, given that at the very time of the crime for which he has been charged, he was working in construction in Playa del Carmen, Quintana Roo, with two of his sons, who corroborate this claim.

On 28 January there was handed down a new sentence of 25 years for Rosario Díaz Méndez, a member of the Voz del Amate who is being held in prison nº5 in San Cristóbal de Las Casas, despite the fact that 37 collectives and international and national organizations together with several individuals have demanded that the principal judge of Simojovel and the state-government of Chiapas grant him “absolution.”

The reasons for which these groups have demanded the release of Rosario Díaz are enumerated in several points of a communique that refers to the lack of evidence for his sentencing.  Rosario Díaz Méndez has always maintained his innocence, given that during the time of the crime he was located in Playa del Carmen, Quintana Roo, working in construction with two of his sons, who also corroborate his story.  Furthermore, there are 4 witnesses who were present at the acts that took place on 4 April 2005 (the ones for which Rosario has been accused) and who claim that there were 4 armed men who assaulted them.  These witnesses at no moment have revealed the identities of these 4 attackers, but none of them has said that they saw Rosario participate in the crime that day.  In this way, when in 2008 these witnesses came to see Rosario, none of them identified him as one of the attackers.

Alberto Patishtán Gómez y Rosario Díaz Méndez, members of the Voz del Amate, together with those in solidarity with the Voz del Amate and Francisco Sántis López have denounced that police officers termed “wolves” on 16 January stole possessions and cash from prisoners during an extended search operation undertaken following the escape of two formerly incarcerated persons which occurred on the morning of that same day.  In a public denunciation they indicated that the police isolated them within the sports complex, stressing that “we are not always in opposition, as sometimes they respect our rights and individual liberties, but the saddest thing about it is that they only came to steal our possessions.”  Patishtán had a number of pens stolen from him, valued at 500 pesos, and another member of the Voz del Amate had a watch stolen which was valued at 120 pesos.

As was noted by La Jornada regarding the possible review of the case of Alberto Patishtán by the Supreme Court for Justice in the Nation (SCJN), Patishtán has noted that he still has not received any response.  “We continue to hope,” he said, using the plural to refer also to Rosario Díaz Méndez,  the other member of the Voz del Amate, who continues to see her case delayed by the judge in Simojovel.  It has now been clearly established that Díaz Méndez is innocent of the crime for which she has been imprisoned now for several years.

Chiapas: VII Anniversary of la Voz del Amate

Some 100 persons met for another year at the Cerss No. 5 in San Cristóbal de Las Casas, Chiapas, to recall the founding of la Voz del Amate, which includes members like Alberto Patishtan Gómez and Rosario Díaz Méndez, after the members’ decision in 2006 to sign the Sixth Declaration of the Lacandon Jungle and begin a sit-in with other prisoners in No. 14 “El Amate” to demand their immediate release.  Visitors from the El Bosque and San Cristóbal de Las Casas municipalities were in attendance, as were others from Italy, Mexico City, Spain, and Argentina, among other palces, to celebrate the VII anniversary of la Voz del Amate, together with those in solidarity with la Voz del Amate.

Among the speeches that took place during the day were included the words of the only female member in solidarity with la Voz del Amate, Rosa López Díaz: “…today I struggle with the pain of being unjustly incarcerated.  I struggle with the pain of having suffered physical and psychological torture when the authorities arbitrarily arrested me.  I struggle with the pain of having lost my son, Natanael.  I struggle with the pain of not being able to live my life with my son Leonardo.”

The Fray Bartolomé de Las Casas Center for Human Rights (CDHFBC), by means of a press-bulletin, has confirmed that “on 3 January of this year, the Magistrate of the First Unitary Tribunal of the Twentieth Circuit ordered a motion of Federal Justice protection in favor of Francisco Sántiz López, upon recognizing that the First Judge of the District of Federal Penal Processes in Chiapas had violated Francisco’s judicial guarantees.”  For this reason, said Center stressed that the “federal government does not have reason to continue depriving Francisco Sántiz López of his liberty, being a Zapatista support-base (BAEZLN) who has been held in the State Center for Social Reinsertion of the Sentenced in San Cristóbal de las Casas No. 5 since 4 December 2011.”  The CDHFBC also recalled that the Chiapas state governor, Manuel Velasco Coello, affirmed in a press-bulletin on 1 January 2013 that “as regards the situation of Professor Alberto Patishtán Gómez and Francisco Sántiz López, their prompt release is for this state government a necessity.”

Also on 10 January, those in solidarity with la Voz del Amate released a public denunciation expressing the situation experienced by several of their comrades, including Rosario Díaz Méndez, a member of la Voz del Amate, who “after three months has had her audience by right postponed […] and will today newly have an audience by right.  We hope that the female judge from Simojovel carry this out responsibly.”
