Chiapas/International: IACHR Grants Cautionary Measures for 12 Communities in Aldama

In a statement published on April 27th, the Inter-American Commission on Human Rights (IACHR) reported that it issued Resolution 35/2021, granting precautionary measures in favor of the Tsotsil indigenous families living in 12 communities in the municipality of Aldama, Chiapas. It considered that the situation in these communities “meets prima facie the requirements of seriousness, urgency and irreparability.”

It explained that the request for said measures alleged that the indigenous families in those places are “in a situation of risk as a result of attacks, harassment and threats due to the presence of armed persons in the area, which would have caused their displacement at various times, in the context of a territorial conflict in the area.”

Although the IACHR obtained information on the actions taken by the State to address the situation, “it warned that armed attacks continued to occur, even despite having a Non-Aggression Agreement; as well as the considerations of the National Human Rights Commission who, on various occasions, exhorted the State to guarantee the rights of the inhabitants of the area.”

Specifically, it asked the State of Mexico to “a) adopt the necessary and culturally pertinent security measures to protect the life and personal integrity of the beneficiary families; specifically, to guarantee security within their communities, and during their displacements, with a view to preventing threats, harassment, intimidation or acts of armed violence by third parties; b) agree on the measures to be adopted with the beneficiaries and their representatives; and c) report on the actions taken to investigate the events that gave rise to the adoption of this precautionary measure and thus prevent its repetition.”
